Dumpster Rental Agreement

Services rendered

Nixon Outdoor Services agrees to provide non-hazardous solid waste collection and disposal services as specified herein and customer agrees to make payments abide by the terms and conditions of this agreement as specified herein.

Waste Material

This agreement is for non-hazardous solid waste which can be disposed of at area non-hazardous solid waste landfills. Customers are responsible for ensuring that waste materials that are banned from landfill disposal are not placed in the rented dumpster and agrees to pay charges, including but not limited to those contained herein, if banned wastes are present in the rented dumpster.

Some of the waste items which are banned from being landfill are listed below.

-Petroleum

-Radioactive materials

-Sealed containers

-Sewage or processed wastewater

-Waste oil

-Vehicle batteries

-Hazardous waste

-Acid

-Caustic materials

-Explosives

-Flammable or volatile liquids

-Human or animal remains

-Hydraulic oil

-Kerosene

-Infectious pathological chemotherapeutic or biological waste

-Tanks/drums

-Tires/mattresses- (Will accept but must be placed on top of dumpster and additional fees will apply. $10/tire $15/mattress)

Additional charges

There are a select number of additional charges that Nixon Outdoor Services can and will assess during the service times. Some of the additional charge items are listed below.

1. Roll-off can only be filled below top rim.

(Above level will result in a $75 OVERAGE CHARGE and possible rejection of load. If the load is rejected it will result in a $150 dry run charge. Extra daily charges will be applied until the dumpster is able to be hauled). Nixon Outdoor Services is not responsible for loading/unloading the container if above level marker.

2. Seven day standard rental

$15/Day if container is needed past the pick up date. It is the responsibility of the customer to call for a pick-up.

3. Nixon Outdoor Services will drop dumpster in the desired location as long as the driver is willing, and truck is able to do so.

Customer is not allowed to relocate dumpster. If customer needs a dumpster relocated on property, there will be a $100 dry run charge for relocate.

4. In the event of the roll-off being blocked-there is an automatic $150 trip charge (If dumpster cannot be picked up).

Nixon Outdoor Services is not responsible for moving OR unloading any debris blocking or hindering the SAFE pickup of the container. If the gate is shut or locked, the same charges apply.

5. Customer shall return the equipment in the condition in which it was provided, normal wear and tear expected.

Fees will apply for damages for repairs such as wet paint inside or outside, wet concrete or plastic dried in or outside dumpster or any other damages.

6. Dumpsters that are rented for flat rate (clean concrete/clean dirt/clean tree debris) are to be clean contents as requested.

If contents are mixed, your rate automatically goes to normal rates, and you will pay by the ton if over ton allowance.

7. Door of roll-off dumpster MUST be shut and latched completely whenever pick up is requested.

If our drivers have to shut or latch the dumpster you will be charged a $100 convenience fee.

Payments

Customer agrees to make payments for any and all charges contained herein by DEBIT or CREDIT prior to delivery of dumpster (NO EXCEPTIONS) NO CHECKS.

If a credit card is initially used for payment, the customer agrees to allow Nixon Outdoor Services to charge subsequent charges and fees contained herein to the credit card. Customer agrees to make immediate payment for all fees and charges and to pay 10% annual interest and all attorney fees, court costs, and lien processing fees for past due balances.

Payment is due prior to delivery of dumpster. Any payments not received within 3 days of delivery will result in late fees. ($5 a day)
